2. Intellectual property

Article 1. Ownership of rights

The website sachet-poulet.com is published by CBS SARL (CBS Emballages), 155 rue du Faubourg Saint-Denis, 75010 Paris, France, SIREN 454 066 879. All elements of the website, in particular the videos and audiovisual works (the “Videos”), the animated 3D technical drawing, the 3D models, 3D files, textures, graphic representations and technical animations (the “3D Modelling”), the photographs, texts, graphic charters and logos, the technical data sheet configurator and the price calculator, together with their software, algorithms, calculation rules, price scales and associated databases, are protected by copyright (art. L.111-1, L.112-1 and L.112-2 of the French Intellectual Property Code, “CPI”), copyright in software (art. L.112-2 and L.122-6 CPI), the sui generis right of the database producer (art. L.341-1 et seq., L.342-1 and L.342-2 CPI) and trade secrets (art. L.151-1 et seq. French Commercial Code). CBS SARL is their exclusive owner. Access to the website does not transfer any right.

Article 2. Prohibitions

Unless CBS SARL has given prior written authorisation, the following are prohibited, in whole or in part, by any means:

1. any reproduction, representation, distribution, screenshot or screen recording, recording or publication of the Videos and the 3D Modelling (art. L.122-4 CPI);
2. downloading, extracting or retrieving the 3D files (glTF/GLB, meshes, textures), videos and images, including through the browser’s developer tools;
3. modifying, adapting, decompiling, reverse engineering or reconstructing the 3D models, code, algorithms, configurator and calculator, except where permitted by law;
4. scraping, harvesting, the use of robots or scripts, and the substantial or repeated extraction of the databases (art. L.342-1 and L.342-2 CPI);
5. using any content of the website to train, fine-tune or feed an artificial intelligence or machine learning system. CBS SARL expressly exercises its right to opt out of text and data mining (art. L.122-5-3, III CPI);
6. embedding in another website or service (iframe, framing, inline linking, embedding);
7. storage, distribution or internal use by a company (intranet, internal database, design office, purchasing department), the private copying exception (art. L.122-5, 2° CPI) being reserved for natural persons (CJEU C-467/08 Padawan; C-470/14 EGEDA);
8. any use to develop or promote a competing product, service or tool, or creating a risk of confusion with CBS Emballages.

Article 3. Trademarks and distinctive signs

The name “CBS Emballages”, the logos and the domain names are the property of CBS SARL. Any reproduction or use without authorisation is prohibited and engages the liability of its author (art. 1240 French Civil Code).

Article 4. Unfair competition and parasitism

Independently of any exclusive right, taking over the 3D models, videos, content, configurator or calculator, or their presentation, in order to benefit without consideration from the investments of CBS SARL, constitutes unfair competition and parasitism engaging the liability of its author (art. 1240 French Civil Code).

Article 5. Proof of prior creation

CBS SARL keeps the dated source files of its 3D models and videos and may establish their date of creation by any means.

Article 6. Technical data sheets and calculator

Technical data sheets and calculator results (estimates, indicative quotes, price scales) are indicative and have no contractual value unless a quote or contract is signed, which prevails. Users must check that they suit their needs.

Article 7. Penalties

Any infringement may constitute counterfeiting (art. L.335-2 and L.335-3 CPI), punishable by 3 years’ imprisonment and a €300,000 fine, increased to 7 years and €750,000 for organised gangs (5 times the fine for legal entities, art. 131-38 French Criminal Code), an infringement of the database producer’s right (art. L.343-4 CPI) and, where applicable, an attack on an automated data processing system (art. 323-1 et seq. French Criminal Code). CBS SARL may bring any civil and criminal action, seek cessation, damages and publication of decisions, and have a counterfeiting seizure carried out (art. L.332-1 and L.332-4 CPI). It may also suspend the offender’s access.

Article 8. Reporting and takedown

To report unauthorised use of our content, or if you believe that content on this website infringes your rights: service.commercial@cbs-emballages.com or by post to CBS SARL, 155 rue du Faubourg Saint-Denis, 75010 Paris, France, stating the URL, the content concerned and your contact details. Anyone aware of an infringement of our rights is invited to report it to us.

Article 9. Governing law and jurisdiction

These terms are governed by French law. Any dispute relating to intellectual property falls within the jurisdiction of the specialised judicial courts (Paris Judicial Court for disputes between professionals, art. D.211-6-1 and R.211-7 of the French Code of Judicial Organisation for software); with regard to consumers, the statutory rules on jurisdiction apply.
